Introduction
These Terms and Conditions govern the use of all products and services provided by Softhost, a trading division of Softkings IT Solutions (Pty) Ltd (“Softhost”, “we”, “our”, or “us”).
By accessing our website, purchasing services, creating an account, or using any service offered by Softhost, you acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions.
If you do not agree to these Terms and Conditions, you should not use our services.

Definitions
Service Provision
Softhost shall use reasonable efforts to provide reliable and secure services. Service availability may occasionally be affected by:
- ›Scheduled maintenance
- ›Emergency maintenance
- ›Network interruptions
- ›Third-party supplier failures
- ›Circumstances beyond our reasonable control
While we strive to maintain high levels of service availability, uninterrupted service cannot be guaranteed.
Customer Responsibilities
Customers agree to:
- ›Provide accurate and complete information.
- ›Maintain the security of account credentials.
- ›Promptly update account information when changes occur.
- ›Use services in accordance with applicable laws.
- ›Refrain from activities that may negatively affect other customers or network operations.
Customers are responsible for all activity conducted through their accounts.
Acceptable Use
Customers may not use Softhost services for:
- ✕Illegal activities.
- ✕Distribution of malware.
- ✕Phishing attacks.
- ✕Spam or unsolicited bulk messaging.
- ✕Copyright infringement.
- ✕Fraudulent conduct.
- ✕Network abuse.
- ✕Activities that threaten the integrity or security of Softhost systems.
Softhost reserves the right to investigate and take appropriate action regarding violations.
Payments & Billing
All services are billed in advance unless otherwise agreed in writing. Invoices must be paid by the due date stated on the invoice. Failure to make payment may result in:
- ›Service suspension.
- ›Service restriction.
- ›Account termination.
Outstanding balances may be subject to collection procedures permitted under South African law.
Domain Registrations
Domain registrations are subject to the rules and policies of the relevant registry authority. Customers acknowledge that:
- ›Domain registrations cannot be guaranteed until successfully processed.
- ›Registration fees are generally non-refundable.
- ›Customers are responsible for ensuring the accuracy of registration information.
Data Protection & Privacy
Softhost is committed to protecting customer information and processes personal information in accordance with the Protection of Personal Information Act, 2013 (POPIA).
The collection, processing, storage, and protection of personal information are governed by our Privacy Policy.
Complimentary Router Programme
As part of selected fibre, wireless, or connectivity services, Softhost may provide a complimentary router or networking device to the customer. The following conditions apply:
- ›The router remains the property of Softhost during the initial twelve (12) month service period.
- ›Ownership of the router transfers to the customer only after twelve (12) consecutive months of active service with all account payments maintained in good standing.
- ›If the service is cancelled, terminated, suspended for non-payment, or transferred before the completion of the twelve (12) month period, the router must be returned to Softhost upon request.
- ›Returned equipment must be in reasonable working condition, allowing for normal wear and tear.
- ›Failure to return the router may result in an equipment recovery fee or replacement charge being added to the customer's account.
- ›Softhost reserves the right to recover or remotely disable equipment where permitted by law and where ownership has not yet transferred to the customer.
- ›Ownership transfer shall occur automatically after twelve (12) consecutive months of active service, provided that all invoices have been paid in full and no material breach of the service agreement exists.
Free Router Offer
Customers who maintain an active fibre service with Softhost for a minimum continuous period of twelve (12) months will become the owners of the supplied router. Customers cancelling prior to the completion of the twelve-month period must return the router to Softhost or pay the applicable replacement value of the equipment.
Limitation of Liability
To the fullest extent permitted by law, Softkings IT Solutions (Pty) Ltd shall not be liable for indirect, incidental, special, punitive, or consequential damages arising from the use of any service.
Customers acknowledge that no technology service can guarantee absolute availability, security, or uninterrupted operation.
Termination
Softhost may suspend or terminate services where:
- ›These Terms are violated.
- ›Required payments remain outstanding.
- ›Fraudulent or unlawful activities are detected.
- ›Continued service presents operational or security risks.
Termination does not remove the customer’s obligation to settle outstanding fees.
Governing Law
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Republic of South Africa.
Any disputes shall be subject to the jurisdiction of South African courts.
Amendments
Softhost reserves the right to amend these Terms and Conditions from time to time. Updated versions shall become effective upon publication on the Softhost website.
